Alternative Dispute Resolution – Your Key to Staying Out of Court

This webinar thoroughly discusses, in a logical order, the advantages and disadvantages of a wide variety of ADR techniques, following a dispute from the project site to the adjudicative forum. Understanding the use of ADR in construction, will make it easier for you to resolve disputes without litigation.
Construction industry disputes are common, can be complex, and disputed amounts are frequently quite large – making it difficult to present issues clearly to non-technical triers of fact. Until the 1980s, the traditional dispute resolution process involved negotiations, possibly mediation, often followed by litigation. Although the construction industry is not typically considered progressive or forward thinking about dispute resolution, it has developed various alternative means to resolve disputes. The end goal is resolution without resorting to traditional, time consuming, and expensive litigation. While some methods are merely variations on a theme, all are different, and their advantages and disadvantages should be considered prior to selection.
