SUMMARY:Mediating Construction Disputes - A Way To Avoid Arbitration & Litigation
DESCRIPTION:Arbitration and litigation are very lengthy and expensive.  Mediation is a good alternative form of dispute resolution in which the parties involved structure and control the process and the outcome.  This webinar focuses on how to prepare for and achieve an acceptable resolution of construction disputes. \nMediation is not new.  It was employed in ancient India and the Islamic world.  In more recent times\, mediation has been widely adopted in the U.S. construction industry as a form of Alternative Dispute Resolution (ADR). \nMediation is often employed\, in lieu of arbitration or litigation\, when negotiations have failed to resolve claims.  We will outline the mediation process and discuss why construction professionals need to learn about mediation.  We will also analyze the good and bad aspects of mediation.  Finally\, we will offer several practical suggestions on how to prepare for\, and be successful in\, mediation. \nParticipants will learn: \n\nthe role of mediator in the process\nwhy mediation so often leads to settlement\, though previous negotiations failed\nhow mediation compares to other forms of ADR\nhow to effectively prepare for mediation\nhow to effectively participate in mediation\nwhat to do after meditation agreement is attained\n\nInstructor: James G. DESCRIPTION:This webinar thoroughly discusses\, in a logical order\, the advantages and disadvantages of a wide variety of ADR techniques\, following a dispute from the project site to the adjudicative forum.  Understanding the use of ADR in construction\, will make it easier for you to resolve disputes without litigation. \nConstruction industry disputes are common\, can be complex\, and disputed amounts are frequently quite large – making it difficult to present issues clearly to non-technical triers of fact.  Until the 1980s\, the traditional dispute resolution process involved negotiations\, possibly mediation\, often followed by litigation.  Although the construction industry is not typically considered progressive or forward thinking about dispute resolution\, it has developed various alternative means to resolve disputes.
