SUMMARY:Reducing Construction Claims Proactively
DESCRIPTION:To avoid all time or cost claims there must be no changes\, no delays\, no shortage of qualified craft labor\, no late material or equipment deliveries\, no bad weather\, etc. – all virtually impossible.  However\, claims do not have to result in disputes.  Disputes arise when contractors and owners cannot resolve claims by negotiation and transfer unresolved issues to the legal system.  This webinar shows owners and their representatives how to avoid disputes at the end of the project through upfront dispute resolution planning during design\, bid and construction phases. \nThe webinar will discuss: \n\nfour types of reviews to be applied to contract documents\nneed for a comprehensive scheduling specification and payment for changes article how to reduce claims based on large numbers of RFIs;\nhow to pre-purchase owner-caused delay and lock in daily delay costs at bidding\nhow to predict weather for the project\nways to preclude disputes at project end by resolving issues w/out arbitration or litigation.\n\nParticipants will learn:  \n\nvalue of planning how to avoid disputes from beginning of project\n“ins and outs” of creating a comprehensive scheduling specification\nvalue and use of a thoroughly drafted Payment for Changes clause\ncost\, value\, and benefits of using a dispute resolution board\nidentify benefits and use of escrow bid documents\, project partnering\, pre-construction audits\, project trending\, and short interval schedule submittals.\nuse of standing negotiation teams and decision ladders\nnew ways to mitigate delay damages and avoid need for difficult cost negotiations and audits in the event of owner caused delay\nways to resolve claims on projects avoiding project close out in court or arbitration\nto use eleven-point checklist of Owner actions to avoid disputes at project end\n\n\ncontractors will better understand intent and operation of such clauses in projects which adopt some\, or all\, of these approaches\n\nInstructor: James G. SUMMARY:Ghost Schedules - What\, How\, and What is the Risk?
DESCRIPTION:This webinar thoroughly discusses uses and risks of Ghost Schedules by both parties for better project control\, decision making\, and faster resolution of claims.  Not uncommon\, but rarely written about\, Ghost Schedules\, also known as secret or shadow schedules\, are used “behind the scenes” on construction projects for various purposes. \nContractors use them to record their original plan – when owners refuse to approve early completion schedules or fail to grant time extensions – as well as to manage subcontractors/suppliers to early finish dates. They are often used for planned early completion schedules\, “target” schedules\, and others’ buy-in for early completion and contemporaneous project decisions.  Contractors are not required to advise owners of their intent to complete the work early.  When owners refuse to accept baseline schedules showing planned early completion dates\, contractors are enticed to use Ghost Schedules to preserve their rights to file delayed early completion claims. \nOwners may also use Ghost Schedules when contractor schedule updates are deemed unusable or unreliable. \nSince Ghost Schedules are not contract schedules there are pros and cons concerning their use.  We will discuss all of these points. \nParticipants will learn: \n\nThe definition of term “Ghost Schedule”\nHow and why Ghost Schedules are created\nWho keeps a Ghost Schedule on project.
