SUMMARY:Ghost Schedules - What\, How\, and What is the Risk?
DESCRIPTION:This webinar thoroughly discusses uses and risks of Ghost Schedules by both parties for better project control\, decision making\, and faster resolution of claims.  Not uncommon\, but rarely written about\, Ghost Schedules\, also known as secret or shadow schedules\, are used “behind the scenes” on construction projects for various purposes. \nContractors use them to record their original plan – when owners refuse to approve early completion schedules or fail to grant time extensions – as well as to manage subcontractors/suppliers to early finish dates. They are often used for planned early completion schedules\, “target” schedules\, and others’ buy-in for early completion and contemporaneous project decisions.  Contractors are not required to advise owners of their intent to complete the work early.  When owners refuse to accept baseline schedules showing planned early completion dates\, contractors are enticed to use Ghost Schedules to preserve their rights to file delayed early completion claims. \nOwners may also use Ghost Schedules when contractor schedule updates are deemed unusable or unreliable. \nSince Ghost Schedules are not contract schedules there are pros and cons concerning their use.  We will discuss all of these points. \nParticipants will learn: \n\nThe definition of term “Ghost Schedule”\nHow and why Ghost Schedules are created\nWho keeps a Ghost Schedule on project. Why?\nWhy and when both contractors and owners use Ghost Schedules\nDifficulties of use and reliance on a Ghost Schedule during project and at completion\nRisks and benefits of Ghost Schedule for both owners and contractors\nPotential use for Side Schedule during project.\n\nInstructor: James G. Zack\, Jr. is Principal of James Zack Consulting\, LLC \nSee Flyer for complete details and registration information.

SUMMARY:Reducing Construction Claims Proactively
DESCRIPTION:To avoid all time or cost claims there must be no changes\, no delays\, no shortage of qualified craft labor\, no late material or equipment deliveries\, no bad weather\, etc. – all virtually impossible.  However\, claims do not have to result in disputes.  Disputes arise when contractors and owners cannot resolve claims by negotiation and transfer unresolved issues to the legal system.  This webinar shows owners and their representatives how to avoid disputes at the end of the project through upfront dispute resolution planning during design\, bid and construction phases. \nThe webinar will discuss: \n\nfour types of reviews to be applied to contract documents\nneed for a comprehensive scheduling specification and payment for changes article how to reduce claims based on large numbers of RFIs;\nhow to pre-purchase owner-caused delay and lock in daily delay costs at bidding\nhow to predict weather for the project\nways to preclude disputes at project end by resolving issues w/out arbitration or litigation.\n\nParticipants will learn: \n\nvalue of planning how to avoid disputes from beginning of project\n“ins and outs” of creating a comprehensive scheduling specification\nvalue and use of a thoroughly drafted Payment for Changes clause\ncost\, value\, and benefits of using a dispute resolution board\nidentify benefits and use of escrow bid documents\, project partnering\, pre-construction audits\, project trending\, and short interval schedule submittals.\nuse of standing negotiation teams and decision ladders\nnew ways to mitigate delay damages and avoid need for difficult cost negotiations and audits in the event of owner caused delay\nways to resolve claims on projects avoiding project close out in court or arbitration\nto use eleven-point checklist of Owner actions to avoid disputes at project end\n\n\ncontractors will better understand intent and operation of such clauses in projects which adopt some\, or all\, of these approaches\n\nInstructor: James G. Zack\, Jr. is Principal of James Zack Consulting\, LLC \nSee Flyer for complete details and registration information.

SUMMARY:Construction Scheduling Games People Play Part 2
DESCRIPTION:The intended purpose of construction scheduling is to assist with proper planning and coordination of a project.  Unfortunately\, construction schedules are often used to help build claims against project owners.  For both owners and contractors\, a careful drafting and reading of the schedule specifications is imperative. Otherwise – Contractors can lose their rights; Owners can lose their shirts. \nThe intent of schedule specifications is to measure progress on the job\, but also to mitigate future delays and resolve past disputes.  This webinar delves into the number of ways construction schedules can be used for the benefit of the project and abused to the detriment of the project Owner.  Based on input from many project schedulers and claims consultants\, it synthesizes some defenses against claims-oriented schedules. \nMuch of the process of building claims using schedules involves “gamesmanship.”  Whether by intentional strategy\, inattention to schedule specs\, or merely sloppy practices\, various schedule “games” arise on projects – you need to be aware of them\, \nThis exclusive two-part webinar identifies more than 15“Scheduling Games” and offers 45 defenses to help prevent schedule gamesmanship. \nSome defenses involve changes to contract document language to implement during design phase.  Other defenses are pragmatic in nature and can be implemented daily by a knowledgeable construction management team – even in the absence of specification language. \nLearn what some industry-recognized specifications have done to combat abuse and why further changes may still be necessary.  This thorough treatment of the subject cannot be presented in one webinar\, so it is being presented in a special two-part series.  A 10- to 15-minute period has been reserved at the end of each session for an interactive question-and-answer period\, so attendees can discuss specific issues or gain additional knowledge about the topics discussed.  My comprehensive paper on this topic will be provided to attendees to serve as a checklist for identifying and addressing schedule games. \nInstructor: James G. Zack\, Jr. is Principal of James Zack Consulting\, LLC \n\nNote:  Part 1 is offered on 10/21/2021 and 11/10/2021\n\nSee Flyer for complete details and registration information.

SUMMARY:Water\, Wind & More...
DESCRIPTION:This webinar highlights issues and technology related to water availability\, plus innovations in generating energy from water and wind. \nWHERE HAS THE WATER GONE?  WHAT TO DO NOW. \nWater collection and distribution worldwide is now based on assumptions that climate change has thrown out the window.  Dams aren’t filling\, river flow is down\, and snow is not building up.  Ironically\, our planet’s surface is 75% water and Earth’s water quantity has not changed since the dinosaur age!  The problem is not overall availability\, but the need for clean\, drinkable water in the right place\, at the right time.  We need available\, proven technologies to create potable water at scale\, economically\, to meet needs of our cities\, farms and industry.   We will highlight a highly innovative approach to fresh water production\, technology to conserve water already in use\, and new ways to make nearby dirty water safe to drink. \nTHE POWER OF WATER \nDams with generators are not the only way to produce significant amounts of energy from rivers and streams.   New innovative underwater turbine generators can now make large amounts of energy from the natural flow of water.  Water can also meet a broad range of HVAC and industrial process needs when it is guided through state of the art solar thermal technology. This economical and environmentally friendly technology offers a new option to meet our heating and cooling needs in buildings. \nWAYS WITH WIND \nNew\, small-scale wind turbines can work on buildings\, homes and even in parks.  They provide a new option to help meet energy needs on a building-by-building and site-by-site basis.  The size of these turbines and the associated solar components make them highly compatible with the built environment.  A portion of this innovative product line presents these wind turbines as a kinetic work of art that will enhance any building and open space – combining utility with beauty or whimsey. \nPresentation Panel: \n\nLarry Eisenberg\, Principal\, Ovus Partners 360\nTrey Taylor\, CEO\, Verdant Technologies\nGlen Finkel\, CEO\, AquOm Water\nKaren Obrien\, Senior VP of Marketing and Co-Founder\, Artic Solar\nNed McMahon\, Founder and CEO\, Primo Energy\n\nSee Flyer for complete details and registration information

SUMMARY:Managing Change and Change Orders on Construction Projects
DESCRIPTION:Change orders are inevitable on construction projects. They act as a safety relief valve for both owners and contractors over the course of construction. While changes cannot be stopped all together\, they can\, and must\, be managed\, for the benefit of both the owner and the contractor\, to enable delivery of successful projects on time and within budget. Therefore\, owners and contractors must learn how to manage changes to the work during construction. \n\n\n\nThis webinar discusses: \n\nhow and why changes arise during the construction phase\nwhat owners can\, and cannot\, change\ntypes of changes to work in progress\nhow each type of change order should be handled on site\nrules of contract interpretation\nwhat damages may be owed under the Changes clause\nhow changes can be resolved on the project site\n\nInstructor: James G. Zack\, Jr. is Principal of James Zack Consulting\, LLC \nSee Flyer for complete details and registration info \n

SUMMARY:Project Risk Management
DESCRIPTION:Risk mitigation can yield significant cost benefits\, yet risk assessment procedures are more widely adopted. This webinar details the “how’s” of implementing Risk Mitigation – identifying project risks and their early warning signs. \nThe complexity of modern construction projects creates great risks for disputes and inefficiency. Good project management demands good risk management and proactive steps to make projects successful. \nIn a wide-ranging national study analyzing 5\,000 projects 43% of owners\, A/E firms\, and contractors reported that a quarter or fewer firms in the construction industry actually employ risk mitigation and management procedures. \nWe will review what the study shows to be common patterns in effective risk management and its breakdown of public and private risk and their most effective means of mitigation. \nParticipants will learn: \n\nThe biggest threats and risks to project success\nConsequences of failing to address these risks\nBest strategies for managing and mitigating risks\nThe industry landscape concerning implementation of risk management\nTop line recommendations to improve bottom line project success\n\nWho would benefit most from this program?   \nProject Owners\, Owner Representatives\, Design Professionals\, CMs\, PMs\, FMs\, Engineers\, Contractors and more. \nInstructor: James G. Zack\, Jr. is Principal of James Zack Consulting\, LLC\, a construction claims consultancy dedicated to helping Owners and Contractors complete projects in the field\, not arbitration or court.   He is a recognized\, published expert in mitigation\, analysis\, and resolution or defense of construction claims and disputes.  In his 49-year career\, he has been involved in public and private projects throughout the U.S. and 39 countries\, working with Owners and Contractors on 5\,000+ claims.  He is Sr. Advisor to Ankura Construction Forum™ and was previously Ex. SUMMARY:Best Scheduling Practices and the Role of the Owner’s Scheduler
DESCRIPTION:We will demonstrate the importance of detailed project schedule specification in a construction contract and identify key components to be used by both parties for better project control\, decision-making and\, if necessary\, claims resolution.  We identify what a schedule is; what a scheduler should be; whose schedule it is; and why many project schedules fail.  We will discuss scheduling issues from various viewpoints and explore the role of a competent project scheduler during planning\, scheduling\, closeout\, and forensic scheduling phases.  Construction scheduling helps ensure that all project activities necessary to complete the work in accordance with contract document requirements are properly planned\, staffed\, coordinated and executed in an orderly and expeditious manner.  It helps Owners evaluate payment applications and proposed contract changes. \nThere is a perceived risk of claims when Owners require contractors to submit schedules then review and accept them.  However\, experienced owners know the risk is outweighed by the value of comprehensive contractor project schedules in assuring effective communication\, measurement\, coordination\, and timing.  Owners must spend time during design to draft scheduling specification commensurate with project size\, detail\, and complexity\, and level of Owner control desired.  Requirements must not be so burdensome that the schedule takes on a life of its own\, becomes unmanageable and is disconnected from the contractor’s actual management of the project. \nParticipants will learn: \n\npurpose\, importance\, necessity of project schedules.\nwhat most standard contract schedule specifications lack and the adverse impacts\nKey specification activities and considerations\nRoles competent owner scheduler must fill & how\nChallenges competent schedulers face\nDetails a project scheduler must master\nNon-technical skills an effective scheduler must use\nPractical\, effective solutions to prevent problems\n\nWho would benefit most from this program?   \nProject Owners\, Owner Representatives\, Design Professionals\, CMs\, PMs\, FMs\, Engineers\, Contractors and more. \nInstructor: James G.
