DESCRIPTION:This presentation uniquely sets forth best practices for both owners and contractors concerning concurrent delays.  Since owners generally do not impose late completion damages until the end of the project\, frequently a contractor’s claim of concurrent delay is not submitted until the project is complete.  This webinar explores mechanisms\, based on some recent court rulings that owners employ to defeat a contractor’s “concurrent delay defense.” \nThis presentation defines the term “concurrent delay”; discusses the background of today’s concurrent delay doctrine in U.S. law; explores three recent court cases – two Federal and the third State – that provide owners with some defenses and offers practical advice to owners and contractors when dealing with the issue of concurrent delay. \nWhen owners impose liquidated or actual damages at the end of a delayed project\, contractors often respond with allegations of concurrent delay.  That is\, contractors argue that some or all of the project delay was actually caused either by the owner or an external force\, concurrent with the contractor’s delays\, and therefore all or some of the late completion damages should be forgiven or excused. \nParticipants will learn: \n\nThe true meaning of the term “concurrent delay”\nbackground of today’s concurrent delay doctrine in U.S. law\nsome court-case-based defenses\npractical advice to owners and contractors for dealing concurrent delay\nwhat to do after meditation agreement is attained\n\nInstructor: James G. SUMMARY:Time Extension Requests – What Does A Contractor Have To Prove?
DESCRIPTION:All construction professionals must learn how to prepare\, analyze\, and justify time extension requests. Owners and their representatives must receive\, analyze\, and recommend a course of action\, and decide on all time extension requests submitted by contractors. Contractors and CM’s @Risk are required to analyze\, prepare\, justify\, and submit time extension requests on behalf of themselves and/or their subcontractors. \nWe will identify the tests set forth by the U.S. Federal Courts to justify excusable and compensable delay time extension requests.  Then we will discuss how these rules are applied for submission and analysis of requests. We will address rules concerning concurrent delay and how courts hold the claimant responsible for allocating concurrent delay. We will highlight two new court rulings which may be “game changers” concerning delays\, time extension requests and the use of concurrent delay as a defense against liquidated damages. \nWe will detail burden of proof and what must be proven to justify time extensions – both excusable and compensable. SUMMARY:RFIs - The Paper War & How to Prevent It
DESCRIPTION:We will look at RFI use and abuse\, including real life data from 1\,400 projects and a sample RFI General Conditions clause to help control the process and reduce the impact of the RFI “paper war.”  We will discuss the genesis of RFIs\, their development in the industry\, a frequent common use\, and their impact on construction projects.  We will draw from data provided by a global construction software provider and other studies to assess how RFIs and the RFI process impact both small- and large-scale construction projects. \nWe will address abuse of the RFI process and how RFIs may be misused to increase profitability – a practice institutionalized to some degree in the past few decades.  We will examine a case study involving a wastewater treatment facility laboratory building to illustrate process abuse and discuss legal arguments for cumulative impact due to numerous RFIs.  We will show how owners inadvertently contribute to the abuse of RFIs by failing to adopt practices that may contractually safeguard against potential negative impacts of the RFI process. \nWe will provide a framework for reducing the impact of RFIs via three principal recommendations:. \nParticipants will learn: \n\ntime and cost impacts of RFIs\nhow the RFI process can be abused and used as the basis of claims\nhow to mitigate adverse impact of RFIs via contractual mechanisms\nvalue of an electronic RFI tracking and monitoring system\nbest management practices concerning RFIs and the RFI process\n\nInstructor: James G. DESCRIPTION:This webinar thoroughly discusses uses and risks of Ghost Schedules by both parties for better project control\, decision making\, and faster resolution of claims.  Not uncommon\, but rarely written about\, Ghost Schedules\, also known as secret or shadow schedules\, are used “behind the scenes” on construction projects for various purposes. \nContractors use them to record their original plan – when owners refuse to approve early completion schedules or fail to grant time extensions – as well as to manage subcontractors/suppliers to early finish dates. SUMMARY:Construction Scheduling Games People Play - Part 1
DESCRIPTION:The intended purpose of construction scheduling is to assist with proper planning and coordination of a project.  Unfortunately\, construction schedules are often used to help build claims against project owners.  For both owners and contractors\, a careful drafting and reading of the schedule specifications is imperative. Otherwise – Contractors can lose their rights; Owners can lose their shirts.  \nThe intent of schedule specifications is to measure progress on the job\, but also to mitigate future delays and resolve past disputes.  This webinar delves into the number of ways construction schedules can be used for the benefit of the project and abused to the detriment of the project Owner.  Based on input from many project schedulers and claims consultants\, it synthesizes some defenses against claims-oriented schedules. \nMuch of the process of building claims using schedules involves “gamesmanship.”  Whether by intentional strategy\, inattention to schedule specs\, or merely sloppy practices\, various schedule “games” arise on projects – you need to be aware of them\, \nThis exclusive two-part webinar identifies more than 15“Scheduling Games” and offers 45 defenses to help prevent schedule gamesmanship.  (Part 2 is 11/30/21) \nSome defenses involve changes to contract document language to implement during design phase.  Other defenses are pragmatic in nature and can be implemented daily by a knowledgeable construction management team – even in the absence of specification language. \nLearn what some industry-recognized specifications have done to combat abuse and why further changes may still be necessary.  This thorough treatment of the subject cannot be presented in one webinar\, so it is being presented in a special two-part series.  A 10- to 15-minute period has been reserved at the end of each session for an interactive question-and-answer period\, so attendees can discuss specific issues or gain additional knowledge about the topics discussed.  My comprehensive paper on this topic will be provided to attendees to serve as a checklist for identifying and addressing schedule games. \nThis webinar is a must for any public or private Owner\, Owner’s Representative\, Contractor\, Subcontractor\, CM\, PM\, Architect\, or other Design Professional providing project oversight services. \nInstructor: James G. DESCRIPTION:Risk mitigation can yield significant cost benefits\, yet risk assessment procedures are more widely adopted. SUMMARY:Best Scheduling Practices and the Role of the Owner’s Scheduler
DESCRIPTION:We will demonstrate the importance of detailed project schedule specification in a construction contract and identify key components to be used by both parties for better project control\, decision-making and\, if necessary\, claims resolution.  We identify what a schedule is; what a scheduler should be; whose schedule it is; and why many project schedules fail.  We will discuss scheduling issues from various viewpoints and explore the role of a competent project scheduler during planning\, scheduling\, closeout\, and forensic scheduling phases.  Construction scheduling helps ensure that all project activities necessary to complete the work in accordance with contract document requirements are properly planned\, staffed\, coordinated and executed in an orderly and expeditious manner.  It helps Owners evaluate payment applications and proposed contract changes. \nThere is a perceived risk of claims when Owners require contractors to submit schedules then review and accept them.  However\, experienced owners know the risk is outweighed by the value of comprehensive contractor project schedules in assuring effective communication\, measurement\, coordination\, and timing.  Owners must spend time during design to draft scheduling specification commensurate with project size\, detail\, and complexity\, and level of Owner control desired.  Requirements must not be so burdensome that the schedule takes on a life of its own\, becomes unmanageable and is disconnected from the contractor’s actual management of the project. \nParticipants will learn: \n\npurpose\, importance\, necessity of project schedules.\nwhat most standard contract schedule specifications lack and the adverse impacts\nKey specification activities and considerations\nRoles competent owner scheduler must fill & how\nChallenges competent schedulers face\nDetails a project scheduler must master\nNon-technical skills an effective scheduler must use\nPractical\, effective solutions to prevent problems\n\nWho would benefit most from this program?   \nProject Owners\, Owner Representatives\, Design Professionals\, CMs\, PMs\, FMs\, Engineers\, Contractors and more. \nInstructor: James G.
