DESCRIPTION:Buildings generate over 40% of greenhouse gas (GHG) emissions contributing to climate change.  Multiple simultaneous forces (severe weather\, natural disaster impacts\, regulations\, financial risk reporting\, government incentives\, public perception\, cheap renewable energy) are exerting intense pressure on construction to address our outsized climate impact.  Here and globally\, our industry needs to adopt a more proactive and data-driven course. \nTo meet published Net Zero Carbon (NZC) targets and avoid worst-case scenarios defined by Paris Accords (2015)\, we must aggressively measure and address the full extent of a building’s global warming potential (GWP) – known as its carbon footprint. For 30 years the industry and regulators focused on energy use\, production\, and conservation. We’ve made enormous progress toward better and more sustainable buildings through energy codes\, energy usage monitoring/measuring\, SMART controls\, and more thermally cooperative materials. \nRegrettably\, this is not enough even as we continue to improve the grid. We cannot “offset” our way out of it or reduce our energy use and production nearly enough to meet required carbon reduction challenges. We must aggressively eliminate emissions at the source\, by stopping emissions from happening in the first place. To do so\, we must make decarbonizing the built environment\, just the new normal way we work. \nWe all have a part to play\, not just Owners and Operators. Everyone in design\, engineering\, construction\, and building maintenance must contribute. Reducing carbon emitted by construction\, and reducing GHG emissions during operation is the only way to meet the challenge. \nHowever\, we cannot manage\, nor change and improve\, that which we do not measure. SUMMARY:Differing Site Conditions – Whose Risk Is It?
DESCRIPTION:Created by the U.S. Federal government in 1926\, the Differing Site Conditions clause is one of the oldest used in public and private construction contracts.  Generally\, the object of the clause is to transfer risk of latent site conditions to the Owner\, thus enticing contractors to reduce their contingency cost at the time of bid.  The promise of the clause is that if the contractor encounters a “materially different” condition during the execution of the work\, the owner will compensate the contractor for the resulting cost and/or time. \nMost construction industry practitioners think they know what the clause means and how it operates. But\, as mid-20th century “dean” of construction law\, Max E. SUMMARY:Cost & Time Impact of Rework on Construction Projects
DESCRIPTION:Rework is frequent and well known in the construction industry\, while draining construction productivity\, profitability\, and the timeliness of project delivery for both Contractors and Owners.  Additionally\, the need for rework can have spinoff or downstream impacts for all project stakeholders.   The causes of rework are\, likewise\, well known: design and construction changes; errors and omissions; project enhancements; operability changes; fabrication changes and errors\, etc.  While rework is common\, the impact has not been thoroughly assessed\, studied\, or discussed. \nHere we will assess and identify the typical cost of rework on a wide range of project types.  We will show how the cost of rework is frequently understated\, then provide an estimate of the true “average cost” of rework. We will also identify the average impact of rework on project duration\, in terms of time\, as well as unrecoverable extended overheads and cost of liquidated damages.
