DESCRIPTION:Rework is frequent and well known in the construction industry\, while draining construction productivity\, profitability\, and the timeliness of project delivery for both Contractors and Owners.  Additionally\, the need for rework can have spinoff or downstream impacts for all project stakeholders.   The causes of rework are\, likewise\, well known: design and construction changes; errors and omissions; project enhancements; operability changes; fabrication changes and errors\, etc.  While rework is common\, the impact has not been thoroughly assessed\, studied\, or discussed. \nHere we will assess and identify the typical cost of rework on a wide range of project types.  We will show how the cost of rework is frequently understated\, then provide an estimate of the true “average cost” of rework. We will also identify the average impact of rework on project duration\, in terms of time\, as well as unrecoverable extended overheads and cost of liquidated damages. DESCRIPTION:All construction professionals must learn how to prepare\, analyze\, and justify time extension requests. Owners and their representatives must receive\, analyze\, and recommend a course of action\, and decide on all time extension requests submitted by contractors. Contractors and CM’s @Risk are required to analyze\, prepare\, justify\, and submit time extension requests on behalf of themselves and/or their subcontractors. \nWe will identify the tests set forth by the U.S. Federal Courts to justify excusable and compensable delay time extension requests.  Then we will discuss how these rules are applied for submission and analysis of requests. We will address rules concerning concurrent delay and how courts hold the claimant responsible for allocating concurrent delay. We will highlight two new court rulings which may be “game changers” concerning delays\, time extension requests and the use of concurrent delay as a defense against liquidated damages. \nWe will detail burden of proof and what must be proven to justify time extensions – both excusable and compensable. SUMMARY:RFIs - The Paper War & How to Prevent It
DESCRIPTION:We will look at RFI use and abuse\, including real life data from 1\,400 projects and a sample RFI General Conditions clause to help control the process and reduce the impact of the RFI “paper war.”  We will discuss the genesis of RFIs\, their development in the industry\, a frequent common use\, and their impact on construction projects.  We will draw from data provided by a global construction software provider and other studies to assess how RFIs and the RFI process impact both small- and large-scale construction projects. \nWe will address abuse of the RFI process and how RFIs may be misused to increase profitability – a practice institutionalized to some degree in the past few decades.  We will examine a case study involving a wastewater treatment facility laboratory building to illustrate process abuse and discuss legal arguments for cumulative impact due to numerous RFIs.  We will show how owners inadvertently contribute to the abuse of RFIs by failing to adopt practices that may contractually safeguard against potential negative impacts of the RFI process. \nWe will provide a framework for reducing the impact of RFIs via three principal recommendations:. \nParticipants will learn: \n\ntime and cost impacts of RFIs\nhow the RFI process can be abused and used as the basis of claims\nhow to mitigate adverse impact of RFIs via contractual mechanisms\nvalue of an electronic RFI tracking and monitoring system\nbest management practices concerning RFIs and the RFI process\n\nInstructor: James G. SUMMARY:Ghost Schedules - What\, How\, and What is the Risk?
DESCRIPTION:This webinar thoroughly discusses uses and risks of Ghost Schedules by both parties for better project control\, decision making\, and faster resolution of claims.  Not uncommon\, but rarely written about\, Ghost Schedules\, also known as secret or shadow schedules\, are used “behind the scenes” on construction projects for various purposes. \nContractors use them to record their original plan – when owners refuse to approve early completion schedules or fail to grant time extensions – as well as to manage subcontractors/suppliers to early finish dates. They are often used for planned early completion schedules\, “target” schedules\, and others’ buy-in for early completion and contemporaneous project decisions.  Contractors are not required to advise owners of their intent to complete the work early.  When owners refuse to accept baseline schedules showing planned early completion dates\, contractors are enticed to use Ghost Schedules to preserve their rights to file delayed early completion claims. \nOwners may also use Ghost Schedules when contractor schedule updates are deemed unusable or unreliable. \nSince Ghost Schedules are not contract schedules there are pros and cons concerning their use.  We will discuss all of these points. \nParticipants will learn: \n\nThe definition of term “Ghost Schedule”\nHow and why Ghost Schedules are created\nWho keeps a Ghost Schedule on project. DESCRIPTION:We will demonstrate the importance of detailed project schedule specification in a construction contract and identify key components to be used by both parties for better project control\, decision-making and\, if necessary\, claims resolution.  We identify what a schedule is; what a scheduler should be; whose schedule it is; and why many project schedules fail.  We will discuss scheduling issues from various viewpoints and explore the role of a competent project scheduler during planning\, scheduling\, closeout\, and forensic scheduling phases.  Construction scheduling helps ensure that all project activities necessary to complete the work in accordance with contract document requirements are properly planned\, staffed\, coordinated and executed in an orderly and expeditious manner.  It helps Owners evaluate payment applications and proposed contract changes. \nThere is a perceived risk of claims when Owners require contractors to submit schedules then review and accept them.  However\, experienced owners know the risk is outweighed by the value of comprehensive contractor project schedules in assuring effective communication\, measurement\, coordination\, and timing.  Owners must spend time during design to draft scheduling specification commensurate with project size\, detail\, and complexity\, and level of Owner control desired.  Requirements must not be so burdensome that the schedule takes on a life of its own\, becomes unmanageable and is disconnected from the contractor’s actual management of the project. \nParticipants will learn: \n\npurpose\, importance\, necessity of project schedules.\nwhat most standard contract schedule specifications lack and the adverse impacts\nKey specification activities and considerations\nRoles competent owner scheduler must fill & how\nChallenges competent schedulers face\nDetails a project scheduler must master\nNon-technical skills an effective scheduler must use\nPractical\, effective solutions to prevent problems\n\nWho would benefit most from this program?   \nProject Owners\, Owner Representatives\, Design Professionals\, CMs\, PMs\, FMs\, Engineers\, Contractors and more. \nInstructor: James G.
