SUMMARY:Pricing Delay Costs - How Owners Deal with Home Office & Jobsite Overhead Costs
DESCRIPTION:This is one of the few webinars dealing directly with problems related to calculating jobsite overhead delay and extended home office overhead costs.  It offers multiple alternatives\, which owners may employ in their contract documents.  We will discuss: \n\nrecoverability of extended field office overhead costs in the event compensable delay arises on a project.\nvarious methods of specifying this element of delay damages in contracts to avoid disputes later\, should compensable delay occur\nIssues surrounding the recovery of extended or unabsorbed home office overhead\n\nSince 1960\, the Eichleay Formula has been used to price extended and/or unabsorbed home office overhead.  Most in the construction industry treat this formula as an accounting mechanism – seldom understanding this “formula” as an estimating tool\, not an accounting method.  Practical problems concerning Eichleay will be identified\, and alternatives explained. \nParticipants will learn: \n\nissues with pricing of contractor jobsite delay damages\nvarious methods of calculating extended field office overhead costs\nmethods to calculate contractor’s extended or unabsorbed home office overhead costs\nEichleay Formula\, including weaknesses/flaws from accountant/auditor\, contractor\, owner perspectives\nalternatives to the Eichleay Formula\n\nInstructor: James G. Zack\, Jr. is Principal of James Zack Consulting\, LLC\, a construction claims consultancy dedicated to helping Owners and Contractors complete projects in the field\, not arbitration or court.   He is a recognized\, published expert in mitigation\, analysis\, and resolution or defense of construction claims and disputes.  In his 49-year career\, he has been involved in public and private projects throughout the U.S. and 39 countries\, working with Owners and Contractors on 5\,000+ claims. \nRegister a team of 3 or more from your organization and save $15 each! \nSee Flyer for complete details and registration information. \nRSVP and you will be sent a link to pay for your registration.

SUMMARY:Concurrent Delay - Is This Still a Contractor's "Get Out of Jail Free Card"?
DESCRIPTION:This presentation uniquely sets forth best practices for both owners and contractors concerning concurrent delays.  Since owners generally do not impose late completion damages until the end of the project\, frequently a contractor’s claim of concurrent delay is not submitted until the project is complete.  This webinar explores mechanisms\, based on some recent court rulings that owners employ to defeat a contractor’s “concurrent delay defense.” \nThis presentation defines the term “concurrent delay”; discusses the background of today’s concurrent delay doctrine in U.S. law; explores three recent court cases – two Federal and the third State – that provide owners with some defenses and offers practical advice to owners and contractors when dealing with the issue of concurrent delay. \nWhen owners impose liquidated or actual damages at the end of a delayed project\, contractors often respond with allegations of concurrent delay.  That is\, contractors argue that some or all of the project delay was actually caused either by the owner or an external force\, concurrent with the contractor’s delays\, and therefore all or some of the late completion damages should be forgiven or excused. \nParticipants will learn: \n\nThe true meaning of the term “concurrent delay”\nbackground of today’s concurrent delay doctrine in U.S. law\nsome court-case-based defenses\npractical advice to owners and contractors for dealing concurrent delay\nwhat to do after meditation agreement is attained\n\nInstructor: James G. Zack\, Jr. is Principal of James Zack Consulting\, LLC\, a construction claims consultancy dedicated to helping Owners and Contractors complete projects in the field\, not arbitration or court.

SUMMARY:Impact Damages - Fact or Fiction?
DESCRIPTION:This unique webinar deals with this very specialized form of claim damages in a very practical way. \nThe intent of the session is to advise project participants on how to resolve impact damages on the project site – not in the courtroom.   \nMost owners and contractors are aware of different types of claims – change\, differing site condition\, suspension of work\, acceleration\, and termination claims.  While most are aware of the direct costs associated with these claims\, many are not familiar with the concept of impact damages\, and how these damages are additive to both the direct and the delay costs arising from claims. \nWe will identify what constitutes legitimate Impact damages.   We will also discuss some impact damage “claims games” – showing how to identify them and suggesting defenses. \nThis webinar will discuss 10 forms of impact damage claims and offer recommendations for addressing each one. \nParticipants will become conversant with the ins and outs of impact damages\, including how to prepare\, analyze\, and resolve them. \nInstructor: James G. Zack\, Jr. is Principal of James Zack Consulting\, LLC\, a construction claims consultancy dedicated to helping Owners and Contractors complete projects in the field\, not arbitration or court.
